Child endangerment laws?

If a mother sends her child to a baby sitter, and the baby sitter's daughter takes the child out of the baby sitter's home, doesn't keep a close eye on her near a busy street, and the child gets hit by a car and killed, what recourse does the mother have? Does this fall under child endangerment?
